| Project Overview

RoHS is a mandatory standard established by EU legislation, with the full name of "Restriction of Hazardous Substances in Electrical and Electronic Equipment". RoHS 1.0, namely the old directive 2002/95/EC, has been implemented since July 1, 2006. Subsequently, RoHS 2.0, namely the new directive 2011/65/EU, came into force on July 21, 2011, and officially replaced the old directive on January 3, 2013, expanding the scope of control and adding new restricted substances.

On December 10, 2024, the European Union discarded the proposal to add medium-chain chlorinated paraffins (MCCPs) and tetrabromobisphenol A (TBBP-A) to the RoHS Directive. Currently, these two substances, MCCPs and TBBP-A, are candidate substances for SVHC in the EU REACH Regulation. When the concentration in articles exceeds 0.1%, obligations such as notification and reporting need to be fulfilled.

| Exemption

RoHS exemptions allow certain materials to temporarily not comply with the RoHS Directive under specific conditions. Exemptions have an expiration date, and extensions can be applied for before the expiration. Enterprises need to pay attention to exemption updates and replace materials in a timely manner. Exemptions are for specific applications, and misuse may result in losses. Technological progress will determine the future of exemption items, and enterprises should develop alternatives to maintain competitiveness.

| Obligations of Enterprises

The EU RoHS Directive requires enterprises to ensure that their electrical and electronic products do not contain specific hazardous substances exceeding the specified limits. Enterprises must conduct product tests, prepare technical documents, provide a declaration of conformity, and affix the CE mark to the products to prove compliance. In addition, enterprises need to monitor the supply chain to ensure that all components and materials comply with RoHS requirements, and conduct product recalls when necessary.

In the EU, law-enforcement inspections of RoHS have gradually become normalized. Enterprises that violate the regulations will face penalties such as product recalls, product delisting, and fines. For those with serious violations, the enterprise's responsible persons may face both fines and imprisonment. It is recommended that enterprises closely monitor the latest developments of the EU's RoHS Directive to adjust their production and compliance strategies in a timely manner.
